Executivo Rio – Terms And Conditions

Please read these terms and conditions carefully before making any reservations as they contain important information about your rights and obligations. By clicking on the “submit” button at the bottom of the registration form, you agree to be legally endorsed by them as they can be modified from time to time, and posted on our website. If the reservation is made by phone, e-mail or fax, it is subject to, and that the client accepts, the terms and conditions of booking of Executivo Rio. This information is available on our website or, upon request, by e- mail or phone.

Executivo Rio is a company registered in Brazil and is therefore subject to Brazilian law. It is also a company licensed by the Ministry of Tourism.

1. GENERAL CONDITIONS

a) Executive Rio has the right to refuse any reservation made by you. When a transfer reservation is made through our website, an automatic reply / confirmation is sent to you with all the information you need to know when you arrive at your destination airport. Arrival information can also be found on our website. If your reservation is not accepted, you will be notified by email within 24 hours from the time the reservation is made.

b) The destination and the origin address in your confirmation / reservation, will be considered as addresses for the execution of the transfer services.

c) When two or more people are included in the same reservation, the person who made and / or purchased the reservation will be considered an agent for all members of the group and accept these booking conditions on behalf of each member of the group.

d) The make, model and type of vehicle used for the transfer service may vary from those shown on the website.

2. RESERVATION CHANGES

a) We do not make any charges for changes to your reservation, if made at least 4 days before the date of travel. The new details must be sent in writing, by e-mail, directly to atendimento@executivorio.com.br.

b) Changes made less than 4 days before the travel date are subject to availability and a fee of R $ 50.00 (fifty reais) will be charged.

c) If a change leads to an increase in price, this difference must be paid at the time of making the consultation.

d) Any changes that do not increase the price will have no extra cost.

3. PRICE

The price of any service is the price displayed on our website at the date and time of your order. We can change the price of any service on our website before a reservation is made. Although we try to ensure that the prices shown on our website are accurate, the price of your reservation must be validated by us as part of the confirmation process. We will inform you if the correct price for a service is higher than that shown on your reservation, giving you the opportunity to cancel the reservation and decide whether or not to pay the correct price. In case of prepayment, if the correct price is higher, we will refund the total amount paid, if you decide to cancel the reservation.

4. PAYMENT CONDITIONS

At Executivo Rio, under certain conditions, a 20% advance payment is required when the reservation is made. Payment can be made by credit card (via Paypal), bank transfer or bank slip in advance.

5. PAYMENT

If payment is made in advance, the following conditions, in addition to the general conditions, apply:

a) In the case of payment with credit / debit cards, you are legally required to provide, for the purpose of purchasing the service, the correct personal information and your credit / debit card details that have sufficient funds or sufficient credit to cover the cost of the service (s). EXECUTIVO RIO reserves the right to validate your credit / debit card details before providing you with the service. If the authorization is not approved, you will be informed, as soon as possible, to the email address provided by you, and depending on your destination and the payment options available for that destination, it offers the possibility to make the payment in R $ (reais) in cash to EXECUTIVO RIO's representative or driver, before starting the service. We reserve the right not to perform the service if this payment is not made.

b) In the case of payment by bank transfer, this must be done at least 10 working days before the date of the service and a copy of the bank receipt, showing the details of the transfer must be received by us by email (atendimento@executivorio.com.br) before the service date.

c) Once the payment has been validated, you will receive a payment confirmation by email. This confirmation is your ticket and must be produced for the representative or driver, both for arrival and departure.

d) Payment is strictly non-refundable, except in circumstances where EXECUTIVO RIO, due to causes beyond its control, cancels or, at its sole discretion, agrees to cancel the reservation.

e) In the case of missed flights or flight delays forcing you to miss your transfer, EXECUTIVO RIO is restricted to the right to charge the full amount of the service.

6. CANCELLATIONS

a) Customers who wish to cancel their reservation must do so by e-mail (atendimento@executivorio.com.br), citing the reservation code, name of the passenger and date of the first service. The reservation will be considered canceled on the date EXECUTIVO RIO receives the cancellation email.

b) Cancellations made up to 7 days before the date of the first transfer will be returned in full, except for an administrative fee of 7% of the down payment.

c) In the event of a cancellation being made less than 7 days before the date of the first transfer, there is no refund.

d) In case of cancellation, the customer will receive a cancellation reference number. This reference number must be quoted in any correspondence with EXECUTIVO RIO.

7. MISCELLANEOUS CONDITIONS

a) Delays / missed flights: in the case of missed flights, forcing you to miss your transfer, EXECUTIVO RIO must be informed by phone / email (atendimento@executivorio.com.br), as soon as you are aware of your situation so EXECUTIVO RIO can try and make alternative arrangements. The alternative transport arrangement is entirely at the discretion of EXECUTIVO RIO and may be subject to an administrative fee that you will be advised of when appropriate.

b) Baggage: Customers are limited to a maximum of luggage (as shown on the website in ¨ Fleets¨). EXECUTIVO RIO must be informed of any extra luggage at the time of booking, for which it could not be a supplement to be paid - which includes sports equipment, wheelchairs, etc. In the event that excess baggage is not declared, additional fees will be charged, at our absolute discretion (payable before shipping) or we reserve the right to refuse to transport the items. All baggage must be clearly identified with the owner's name and destination address.

c) Wheelchairs: Vehicles destined for the TRANSPORTATION SERVICE DOES NOT have wheelchair ramps and are not adapted for disabled people. All passengers must be able to climb the steps of the bus (in some vehicles they can be double-decker and include some interior steps).

d) Children: Brazilian law states that children must use a suitable child seat until they reach 8 years of age or until they reach a height of 100 cm.

In the private transfer, all children and babies have a child seat for occupying the vehicle, regardless of age and, therefore, must be included in the total number of passengers at the time of booking.

e) Behavior: EXECUTIVO RIO reserves the right (and delegates to its drivers and agents designated on the right) to refuse to transport anyone who is under the influence of alcohol or illicit drugs and / or whose behavior is considered a threat to the driver, the vehicle or the other passenger (s). Neither alcohol consumption nor smoking is permitted in any of our vehicles.

f) Tolls / expressway. All transfers are made using the motorway. However, short distances are much faster using the national road.

g) Performance:

i) EXECUTIVO RIO will use all reasonable means to ensure that your vehicle (s) will be at your meeting point at the time indicated in your confirmation, and that it will arrive at its destination in time. However, EXECUTIVO RIO does not accept any responsibility in the event of a delay due to causes beyond its control.

ii) While EXECUTIVO RIO will do its best to reduce any delay as much as possible, it should be understood that, during the summer, peak and weekend season there may be delays incurred before your transportation is available.

iii) The vehicles are fully insured against accidents involving passengers and third parties, as required by local legislation. However, while all care is always taken, customers' property is conducted entirely at their own risk and no liability can be accepted for loss or damage. It is the passenger's responsibility to check their own travel insurance.

iv) When customers book this type of service they understand that they can wait up to 1 hour from the moment they reach our representative and a maximum of 15 stops before reaching the destination. The collection time for the trip to the airport can be up to about 6 hours before the flight's departure time.

v) EXECUTIVO RIO will not accept any responsibility for any failure, difficulty or service if customers, at the time of their trip, do not have the appropriate travel documents with them for their reservation and describing the entry and exit procedures. EXECUTIVO RIO will not agree with any requests for reimbursement or compensation arising from any failure in the service if customers do not adhere to the established procedures.

vi) The appointed EXECUTIVO RIO local supplier will make every effort to transport the passenger (s) with the minimum of discomfort and inconvenience to his / her destination, as indicated in the confirmation document. However, circumstances beyond our control may prevent the realization of this responsibility. The following are examples of circumstances that are not within our control:

• accidents causing vehicle delays

• exceptional or severe weather conditions

• compliance with police requests

• road deaths and accidents

• vandalism and terrorism

• unforeseen traffic delays

• industrial action by third parties

• problems caused by other customers

• other circumstances that affect the safety of passengers

• properties that are not accessible for the type of service reserved

viii) In very rare cases, the indicated local supplier may drop off or pick up passengers from a different point other than the hotel's address, if the car for the exact specified accommodation may cause undue delay or inconvenience to other passengers.

ix) EXECUTIVO RIO will only be responsible for any reasonable and predictable consequential losses arising directly from a breach in the contract. In such cases, our liability will be limited to a maximum of R $ 50.00 per booking.

x) EXECUTIVO RIO reserves the right at any time to assign any part of this Agreement (or all of it) to any associated company or subsidiary or to any third party.

xi) If the appointed supplier fails, due to any reasonable circumstances under its control, to deliver its passengers to their confirmed destination, EXECUTIVO RIO will do its best to provide suitable replacement transportation, such as another private car, taxi etc. Any refund made by EXECUTIVO RIO for the costs of an alternative means of transport incurred by the passenger to reach their ticket destination will be no more than the cost of arriving at that destination by taxi.

8. CUSTOMER RESPONSIBILITY:

a) It is the client's obligation to report any difficulties with the services that EXECUTIVO RIO provides, in the shortest possible period, in order to be given a fair opportunity to correct all problems as soon as possible.

b) It is the client's obligation to do everything in his / her power to minimize any loss. If the transport is more than 10 minutes late, it is the customer's responsibility to notify the EXECUTIVO RIO representative by telephone so that appropriate measures can be taken.

c) If the customer does not contact the EXECUTIVO RIO representative, we will not assume any responsibility for the additional costs incurred by the customer, for example, in the case of missed flights, transportation costs, etc.

d) EXECUTIVO RIO will not be responsible for any additional costs incurred by customers in reaching their destination, if they have not contacted our representative by phone to inform them of any problem when it arises. There is a 24 hour emergency number sent with the confirmation details. If customers do not receive this emergency number, it is their obligation to contact EXECUTIVO RIO in advance and request.

These Conditions of Carriage and any transportation that we agree to provide to you (in relation to you and / or your Baggage) will be governed by Brazilian law, and any dispute between you and EXECUTIVO RIO regarding or arising out of such transportation in any way, will be subject to the non-exclusive jurisdiction of the Courts of Rio de Janeiro (Brazil). These terms and conditions supersede all other terms and conditions applicable prior to using our website and / or selling the service.

In the unlikely event of a lawsuit EXECUTIVO RIO takes all customer inquiries very seriously and therefore, if you are not satisfied with any part of the service provided, please contact us within 28 days of the transfer date to that we can investigate any problems. Details should be sent to us by email (atendimento@executivorio.com.br). All comments must be made in writing - no verbal statements will be accepted. We try to resolve any complaints in writing within a maximum of 28 days.

Your privacy is important to us and, although we, EXECUTIVO RIO may, from time to time, send you information, including offers, etc., your personal data will not be passed on to third parties.

When a transfer service is booked with us, we must collect certain information in order to process the booking. The necessary information depends on the reserved service and will be part of a permanent record of your transactions. This information is used to be able to check your records quickly and efficiently and will only be kept if it is relevant to your permanent record.
